Licensing Act 2003 Application for a Variation of a Premises Licence pdf icon PDF 9 MB

Minutes:

Members of the Statutory Licensing Sub Committee of the Council’s Statutory Licensing Committee were asked to consider an application for a full variation for a premises licence, under the Licensing Act 2003 to which there have been representations from residents for Canteen & Cocktails, 1 High Street, Norton, Stockton - on -Tees, TS20 1AH.

 

Representations had been received from Environmental Health & Public Health opposing the variation application, full details of which were contained within the Officers report, however prior to the commencement of the meeting Environmental Health & Public Health withdrew their objections as conditions had been agreed with the applicant.

 

Police had also agreed conditions with the applicant prior to the hearing.

 

Representatives for the Licensed premises attended the meeting and were given the opportunity to make representation.

 

The Chair introduced all persons present and explained the procedure to be followed during the hearing.

 

A copy of the report and supporting documents had been provided to Members of the Sub-Committee as well as all persons present.

 

The Licensing Officer presented the report to the Statutory Licensing Sub-Committee.

 

Members of the Sub-Committee of the Council’s Statutory Licensing Committee heard the above application, full details of which appeared before the Members in their agenda and background papers.

 

Members noted that the application was for a full variation for a premises licence, for Canteen & Cocktails, 1 High Street, Norton, Stockton-on Tees, TS20 1AH, where representations had been received from residents and regulatory authorities, although there had been representations withdrawn due to conditions being agreed.

 

 

The main topics discussed were as follows:

 

- The variation had been submitted to bring the premises into line with other premises operated by the applicant. As agreed with Officers the live music would be operated as per the agreed terms.

 

- Members noted that representations from Environmental Health & Public Health objecting to the variation had been withdrawn prior to the meeting and one of the three residents had also withdrawn their objections.

 

The Sub-Committee noted that the residents that had objected to the application were concerned about potential noise nuisance. The Sub-Committee also noted that they must consider the application for a variation of the premises licence on its own merits.

 

On balance it appeared to the Sub-Committee that the proposed conditions would ensure that residents were not subject to public nuisance and that the licensing objectives would not be undermined.

 

After considering all of the evidence and representations, the Committee were of the view that the application should be granted.

 

RESOLVED that the application for a variation of a Premise Licence Canteen & Cocktails, 1 High Street, Norton, Stockton on Tees, TS20 1AH, be granted with the agreed conditions between the regulatory authorities and the applicant.

Oxford Convenience Store, Oxford Road, Stockton On Tees.

Minutes:

Members of the Statutory Licensing Sub Committee were asked to consider that the item for an application for Oxford Road Convenience Store, Oxford Road, Stockton - On - Tees be withdrawn from the agenda, as Officers had agreed conditions with the applicant prior to the meeting.

 

In addition, following the agreed conditions the objections of Cleveland Police, Environmental Health and Public Health had been withdrawn.

 

Members agreed to withdraw the application due to the agreed conditions between Officers and the Applicant.

 

RESOLVED that the application for Oxford Road Convenience Store, Oxford Road, Stockton - On - Tees be withdrawn for the reasons as detailed above
